Boundary Adjustments / Relocations
Any adjustment of a legal boundary is classified as a subdivision under the Resource Management Act and it will require subdivision consent. However with this type of subdivision, as opposed to one that creates additional building sites, there are fewer issues to be considered.
As usual the relevant issues will depend on the rules in the district plan and the local authority will need to be assured that the amended sites comply with their requirements.
Once consent is granted any conditions will need to be fulfilled and a Land Transfer survey will be undertaken to peg the new boundaries and relate them to the existing site boundaries. A Land Transfer dataset (plans and accompanying documents) will be prepared for approval by Land Information New Zealand (LINZ).
Finally a solicitor will apply for new certificates of title to be issued to reflect the amended boundary situation.
